This is the privacy policy ("Privacy Policy") that your use of the Avia Application ("Site") and website (“Website” and collectively with the Site, the “Site”) owned by Avia Technologies, Inc and its affiliates and subsidiaries (collectively "Company") are committed to protecting the confidentiality and security of your personal information. This Privacy Policy describes the personal information we collect from or about you, how we use and to whom we disclose that information.

This Privacy Policy is incorporated into and is subject to Company’s Terms of Use. Your use of the Site and any personal information you provide on the Site remains subject to the terms of this Privacy Policy and our Terms of Use unless such personal information is related to an individual who seeks to be, is or was employed by Company.

What is Personally Identifiable Information?

For the purposes of this Privacy Policy, “personally identifiable information” means information that identifies a particular individual, such as name, physical address, email address, social security number and phone number.

Security?

The Company uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. Information The Company Collects

You can use certain portions of the Site without disclosing any personal information about yourself. However, in order to utilize certain services of the Site (such as the ability to book a flight), you may be required to create a user account ("Account"). If you create an Account, the Company collects a variety of information such as your name and address, e-mail address, telephone number account preferences, and other information about you.

In addition, we collect the personal information that you submit to the Site, such as your name, address and any other contact or other information that you choose to provide by:

  • using the "contact us" portion of this Site;
  • in purchasing products or services from the Site;
  • by using embedded social plug-ins or widgets from social media platforms such as Facebook, Twitter, Linkedin, Pinterest, Instagram, etc.
  • In addition, by interacting with the Site or booking flights using the Site, we additionally learn information about your transaction details and history. When you make a purchase, book a flight, fly with us, or communicate with us, we may learn details about you such as: travel plans, disability or health information (such as may be required to provide accommodations or to provide assistance in case of a health incident during a flight), emergency contacts, dietary restrictions, weight information, gender and date of birth, age or age-range, redress number, travel preferences, purchase information, and other information relating to your travel. Similar information about you may be provided when others book a flight on your behalf.

    Additionally, we may gather information required to verify your identify, conduct a background check, or comply with government-mandated security requirements. This information may include your social security number, country of origin, passport, driver’s license, known traveler number, or other government-issued identification.

    When you visit the Site, the Company may send one or more cookies - a small text file containing a string of alphanumeric characters - to your computer that uniquely identifies your browser. The Company uses both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the Website. Persistent cookies can be removed by following your web browser help file directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Website may not function properly if the ability to accept cookies is disabled.

We may share information with companies in the mobile Site industry (such as carriers, operating system and platform developers, and Site stores).

    The Company does not share your personally identifiable information (such as name or email address) with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out.     Your California Privacy Rights

    If you are a resident of California, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by the Company or its subsidiaries to a third party for the third party’s direct marketing purposes. You may make such a request once per calendar year. To obtain this information, please send an email message to team@flyavia.net with “Request for California Privacy Information” in the subject line and in the body of your message. The Company will provide the requested information to you at your e-mail address in response. Please be aware that not all information sharing is covered by the “Shine the Light” and only information on covered sharing will be included in our response.

    The Company may share non-personally-identifiable information (such as anonymous user usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with Google and other interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Site.

    The Company may release personally identifiable information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright Law) or respond to a court order, subpoena, or search warrant or to prevent fraud or injury to you, the Company or others.

    You may unsubscribe from promotional emails from the Company by following the unsubscribe link included in each such email. You may not opt-out of administrative emails (for example, emails about your purchases or other transactions) for your registered account. You can opt out of text messages from the Company by replying to a text from us with “STOP.”

    Our Commitment To Children’s' Privacy

    Protecting the privacy of young children is especially important. For that reason, the Company does not knowingly collect or maintain personally identifiable information or non-personally-identifiable information on the Site from persons under 13 years of age, and no part of our Site is directed to persons under 13. If you are under 13 years of age, then please do not use or access the Site at any time or in any manner.     The Site is hosted in the United States and is intended for and directed to users in the United States.     Notice to California Residents

    Residents of the State of California may request a list of all third-parties to which the Company has disclosed certain personal information (as defined by California law) during the preceding year for those third-parties’ direct marketing purposes.     For all requests, you must put the statement “Your California Privacy Rights” in the body of your request, as well as your name, street address, city, state, and zip code. In the body of your request, please provide sufficient information for the Company to address your request. You need to attest to the fact that you are a California resident and provide a current California address for the Company’s response. Please note that requests will not taken via the telephone by facsimile, and the Company is not responsible for notices that are not labeled or sent properly, or that do not have complete information.

    As of the Effective Date listed above, there is no commonly accepted response for Do Not Track signals initiated by browsers. Therefore, the Company does not respond to such signals or to other mechanisms that provide the ability to exercise choice regarding the collection of personally identifiable information regarding your online activities over time and across third party websites or online services.
